Golander Terms of Service

Welcome to Golander! These Terms of Service ("Terms") govern your use of the Golander mobile application and related services (collectively, the "Service"). Golander is operated by Golander ("we," "us," or "our"), based in Newark, NJ, United States.

By creating an account or using Golander, you agree to these Terms. If you don't agree, please don't use our Service.

1. Acceptance of Terms

By accessing or using Golander, you confirm that:

  • You have read and understood these Terms
  • You agree to be bound by these Terms
  • You meet the eligibility requirements below
  • You agree to our Privacy Policy

2. Eligibility

Age Requirement

You must be at least 16 years old to use Golander.

By creating an account, you confirm that you are 16 years of age or older. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

Account Eligibility

To use Golander, you must:

  • Be at least 16 years old
  • Provide accurate and complete registration information
  • Not have been previously banned from the Service
  • Not use the Service for any illegal purpose

3. Your Account

Account Creation

To use most features of Golander, you need to create an account. When you do:

  • Provide accurate, current, and complete information
  • Keep your login credentials secure and confidential
  • Notify us immediately if you suspect unauthorized access
  • You are responsible for all activity under your account

Account Security

You're responsible for maintaining the security of your account. This means:

  • Choose a strong, unique password
  • Don't share your password with anyone
  • Don't let others use your account
  • Log out on shared devices

One Account Per Person

Each person may maintain only one Golander account. Creating multiple accounts may result in termination of all accounts.

4. What Golander Is (and Isn't)

What We Are

Golander is a habit-tracking and accountability tool designed to help you:

  • Build positive routines
  • Track daily, weekly, and monthly goals
  • Maintain streaks and see your progress
  • Optionally share goals with friends and family for accountability

What We Are NOT

Golander is not a medical, mental health, or therapeutic service.

  • We do not provide medical advice, diagnosis, or treatment
  • We are not a substitute for professional healthcare
  • We do not employ licensed therapists, doctors, or counselors
  • Our app is not designed to treat any medical or mental health condition

If you're experiencing a health concern or mental health crisis:

  • Consult a qualified healthcare professional
  • Contact a crisis helpline (e.g., 988 Suicide & Crisis Lifeline in the U.S.)
  • Seek emergency services if needed

No Professional Advice

Any information, suggestions, or content in Golander is for general informational purposes only. It should not be considered professional advice of any kind.

5. Acceptable Use

What You Can Do

  • Track your personal habits and goals
  • Share goals with friends and family (with their consent)
  • Use the Service for lawful personal purposes
  • Provide feedback and suggestions

What You Cannot Do

Harmful Behavior:

  • Harass, bully, or intimidate other users
  • Share content that is hateful, discriminatory, or promotes violence
  • Impersonate others or misrepresent your identity
  • Stalk or invade the privacy of others

Misuse of the Service:

  • Use the Service for any illegal purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Circumvent any security features
  • Use automated tools (bots, scrapers) without permission

Intellectual Property Violations:

  • Infringe on our or others' intellectual property rights
  • Copy, modify, or distribute our app without permission
  • Reverse engineer or decompile our software

6. User Content

Your Content

"User Content" means any information you provide through Golander, including habit titles, notes, profile information, and shared messages.

Ownership

You own your User Content. We don't claim ownership of your habits, notes, or personal data.

License to Us

By posting User Content, you grant us a limited license to store and display your content to provide the Service. This license is non-exclusive, royalty-free, and terminates when you delete your content or account.

7. Sharing and Social Features

Inviting Others

You may invite friends and family to view your shared goals. When you do:

  • Only invite people you know and who consent to receiving invitations
  • Don't spam or send bulk invitations
  • Respect others' decisions not to join

Shared Accountability

When you share goals with others:

  • You control what you share (private by default)
  • Shared users can see completion status for shared goals only
  • You can revoke access at any time

8. Intellectual Property

Golander and its contents are protected by intellectual property laws. This includes the Golander name, logo, branding, app design, and software code.

You may not use our intellectual property without written permission.

9. Third-Party Services

Golander may integrate with third-party services (e.g., authentication providers, analytics). These services have their own terms and privacy policies. We're not responsible for third-party services.

10. Fees and Payments

Current Pricing

Golander is currently free to use. We may introduce paid features in the future.

Future Paid Features

If we introduce paid features:

  • We'll clearly disclose pricing before you purchase
  • You can continue using free features without paying
  • We'll provide reasonable notice of any pricing changes

11. Disclaimers

"As Is" Service

GOLANDER IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

No Health Guarantees

We make no guarantees about health outcomes. Using Golander does not guarantee you'll build or break any habit, and is not a substitute for professional care.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOLANDER'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM (OR $100 IF YOU HAVEN'T PAID ANYTHING).

We are not liable for any indirect, incidental, special, or consequential damages, lost profits, or personal injury.

13. Indemnification

You agree to indemnify and hold harmless Golander from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your User Content.

14. Dispute Resolution

Informal Resolution First

Before filing any formal dispute, you agree to contact us at legal@golander.app and attempt to resolve the issue informally for at least 30 days.

Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles.

Jurisdiction

For any disputes not resolved informally, you agree to submit to the personal jurisdiction of the state and federal courts located in Essex County, New Jersey.

Class Action Waiver

You agree to resolve disputes individually. You waive any right to participate in class actions or representative proceedings.

15. Termination

By You

You may stop using Golander and delete your account at any time through Settings → Account → Delete Account.

By Us

We may suspend or terminate your account if:

  • You violate these Terms
  • We're required to by law
  • We discontinue the Service
  • Your conduct harms other users or our business

16. Changes to These Terms

We may update these Terms from time to time. When we do:

  • Minor changes: We'll update the "Last Updated" date
  • Material changes: We'll notify you via email or in-app notification at least 30 days before changes take effect

Continuing to use Golander after changes take effect means you accept the new Terms.

17. General Provisions

  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Golander.
  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
  • No Waiver: Our failure to enforce any right doesn't waive that right.
  • Assignment: You may not assign your rights under these Terms. We may assign our rights to any affiliate or successor.
